Takedown Policy

Take down / Request to remove policy

The Kirkburton Village Archive acts in good faith when publishing material on its website.

Much of our collection comes from local people, families and community groups. Before we publish an item, we check its copyright status and make reasonable efforts to contact rights holders for permission to make it available online.

Some material may still raise concerns. This applies in particular to recent photographs, publications and records that include people who are still living.

Temporary removal

Material may be taken down temporarily when we receive a written request, sent to [email address].

We will acknowledge your request within [5] working days. We will normally remove the item from public view while we assess whether it should be removed permanently.

Grounds for permanent removal

The Kirkburton Village Archive will approve continued withdrawal of material only if at least one of the following applies:

  • Making the material available online infringes copyright.
  • The material contains personal information about someone who is still alive, and continued online access would be unlawful or unfair to them under UK data protection law (UK GDPR and the Data Protection Act 2018).
  • The material is defamatory or obscene.
  • Publishing the material breaks the terms agreed with the person or group who donated or lent it to the archive.
  • The material was published in error and removal is needed to correct the mistake.

How to make a request

Please email info@microform.digital with:

  • Your name and contact details
  • The item or items you want removed, including the web address (URL) or reference number
  • The reason for your request

If your request relates to copyright, please provide evidence that you are the rights holder, their successor or their representative.

If your request relates to personal information, please tell us how the material relates to you. For example, you may appear in a photograph or be named in a document.

What happens next

We will review your request and tell you our decision within [30] days.

If we uphold your request, the material will stay offline. In some cases we may offer another option, such as blurring a face, removing a name or restricting access to part of an item.

If we do not uphold your request, we will explain why and restore the material to the website.
